TERMS & CONDITIONS



A contract exists between person(s) named on our booking form (hereafter referred to as 'customer') and Motorcycle-Tours-Scotland (hereafter referred to as 'MCTS') when a completed booking form has been submitted by the customer from 'MCTS' website and acknowledged by 'MCTS' by email. By entering into this contract the 'customer' accepts in full, and will be bound by, the following terms and conditions.

Booking:
A booking is activated when the 'customer' provides information via the booking facility provided on 'MCTS' website. A booking acknowledgement will be issued to the 'customer' by 'MCTS' via email which will confirm the booking details made and that 'customers' place(s) are reserved on their chosen tour. An email deposit invoice will also be issued to the 'customer' requesting payment of a tour deposit.

Deposit and Payment:
A deposit of £100 per 'customer' will be required against a booking. This will be requested by email deposit invoice allowing the 'customer' to make payment securely via PayPal. On receipt of deposit payment 'MCTS' will issue the 'customer' with an account statement confirming deposit paid, the balance sum and date it will become due for payment. A final invoice will be issued by 'MCTS' in order that the 'customer' can make payment of the final balance no later than 30 days prior to commencing the tour. Tours booked within 30 days of departure will require payment in full and 'MCTS' will issue a final invoice to the 'customer' instead of the aforementioned deposit invoice. Late payment may result in loss of deposit and cancellation of your place on a tour. All payments will be requested by email invoices which will provide the 'customer' with the facility to make secure PayPal electronic payments.

Surcharges:
Our tours are priced to be very competitive; however, circumstances beyond our control might dictate that the cost of a tour increases. In such circumstances 'MCTS' will absorb increases of up to 3% of the published tour price but any increases above 3% will result in a surcharge to the final invoice price. 'MCTS' will advise the 'customer' of such instances to obtain acceptance of contract change.

If the 'Customer' Cancels:
Cancellations must be notified in writing. In this event, the following terms will apply:
- Bookings cancelled more than 30 days prior to start of the tour will result in a refund of all sums paid less £40 per 'customer'.
- Bookings cancelled between 30 and 15 days prior to start of the tour will result in a refund of 50% of the tour price.
- Bookings cancelled less that 15 days prior to start of the tour will result in no refund.
Exceptions to this policy will not be made for any reason including war, riots, civil unrest, terrorism, natural disaster, industrial disputes, weather and/or personal emergencies and there will be no refund for arriving late or leaving a tour early. To cover the instances mentioned it is strongly recommended that all 'customers' arrange Holiday Cancellation Insurance.

If 'MCTS' Cancel:
We reserve the right to cancel any tour however; this would only become necessary in exceptional circumstances. In such an event, 'MCTS' would hope to offer the 'customer' an alternative. If this were not possible or acceptable, 'MCTS' would issue a full refund. 'MCTS' accepts no responsibility for and shall have no liability in respect of any loss, damage, alterations, delays or changes arising from circumstances which are outside their control.

Price Guarantee:
Prices stated in 'MCTS' website are per person. All information provided in the website attempts as far as possible to provide details of the tour to be undertaken, its duration, outline route and nature and details of accommodation and services. Further details will be provided if becoming known to 'MCTS' but if the 'customer' becomes aware at any stage that the information does not coincide with their understanding of the touring holiday described by 'MCTS' and expected, the onus will be upon the 'customer' to intimate their intention to cancel the booking before the 30-day period referred to previously.

Responsibilities and Risk:

- 'MCTS' Responsibilities

'MCTS' will accept responsibility to supply you with a tour package as near as possible as described in our website.
'MCTS' will accept responsibility to ensure that services provided by third parties meet as near as possible the standards described in the website.

- 'Customer' Responsibilities:

To be a competent rider with a motorcycle that is road legal, mechanically sound and suitable for touring.
To hold a valid driving licence for riding a motorcycle.
To hold a valid certificate of insurance covering the machine, rider and pillion.
To have the ability to get rider and/or pillion and/or motorcycle home in the event of breakdown, accident or emergency. It is strongly recommended that 'customers' arrange Breakdown, Accident and Recovery insurance.

- 'Customer' Accepted Risk

Participation on our tour is entirely at 'customers' own risk.
'MCTS' is not responsible or liable for any injuries a 'customer' may suffer, fatal or otherwise.
'MCTS' is not responsible or liable for any loss or damage to 'customers' property, including motorcycle, irrespective of cause.
'MCTS' is not responsible or liable for motoring offences, speeding and/or parking fines incurred by any 'customer' whilst on tour.

Complaints:
In the event of a complaint a 'customer' should approach the tour guide in the first instance and if still dissatisfied should contact Matt. McElroy either in person when on tour, or by email or phone as shown on the contact page in the website.
